What Is a Lemon Law Buyback? The California Lemon Law defines a car as a “lemon” when a reasonable number of repair attempts have not resolved a warranty-covered problem that substantially impairs the vehicle’s use, value, or safety. The vehicle’s manufacturer must either replace a lemon or repay all of the costs associated with buying and attempting to repair the vehicle.
The Buyback Amount is Based on:
● Any money you’ve paid towards buying the vehicle, including down payments and monthly payments made
● Your remaining loan balance on the vehicle
● Collateral costs, such as sales or use tax, license fees, registration fees, and other official fees
● Incidental costs, including reasonable repair, towing, and rental car fees incurred because of the vehicle’s failure
The law also provides the manufacturer a “mileage offset” or “usage fee.” This reduces the buyback payment based on how much the buyer used the vehicle before trying to get the problem repaired. The mileage offset is determined by dividing the vehicle’s mileage before repairs by 120,000 and multiplying it by the actual purchase price.
