Lemon Law Buyback in California

One of the remedies available if you have purchased a defective car under warranty in California is a buyback under California’s Lemon Law. If you have been saddled with a lemon, you may choose to have the money you have spent on the vehicle refunded, or you may demand a replacement vehicle. Many consumers choose a buyback refund instead of accepting a new vehicle.

Whatever you request to resolve problems you’ve had with a lemon automobile, the car’s manufacturer is going to be reluctant to part with the thousands of dollars you have spent on the car. You’ll need an experienced Lemon Law attorney to deal with the manufacturer on your behalf.

What is a Lemon Law Buyback?

A car buyer (or lessee) whose vehicle qualifies as a “lemon” under California law (Civ. Code, § 1793.2 et seq.) may choose to pursue the Lemon Law buyback process. It’s a legal process in which vehicle manufacturers are required to buy back cars that meet the requirements of the California Lemon law.

A vehicle is considered a lemon in California if, after a reasonable number of repair attempts, the manufacturer or its affiliated dealership cannot fix a problem that:

  • Is covered by the manufacturer’s new-vehicle warranty,
  • Substantially impairs the use, value, or safety of the vehicle, and
  • Is not caused by unauthorized or unreasonable use of the vehicle after sale.

In a lemon law buyback, the manufacturer is required to refund the purchase price of the vehicle minus a reasonable amount for its use since the purchase date.

Under a buyback or replacement, the manufacturer is also to pay all sales tax, registration, and license fees and refund all incidental costs incurred by the buyer, including reasonable repair, towing, and rental car costs.

How To Initiate a Lemon Law Buyback?

To qualify for a Lemon Law buyback, your vehicle must be covered by a written warranty and the manufacturer must have had the opportunity to repair your vehicle.

If the problem with your vehicle may threaten your health and safety, you typically must allow the manufacturer two opportunities to repair the problem. If the problem is less serious, the manufacturer may get four or more repair attempts.

  • Documentation is Key: You need to keep all records of the dealership’s (manufacturer’s) attempts to repair your vehicle to prove that your vehicle qualifies as a lemon. You’ll need copies of them to accompany your complaint.
  • Filing a claim: If the manufacturer does not resolve the issue within a reasonable number of, a Lemon Law attorney can submit the appropriate to initiate a Lemon Law claim.
  • Before filing a Lemon Law claim: You should speak to a California Lemon Law attorney before you attempt a Lemon Law claim on your own.
